I have recently been granted a temporary protection order. I think that I do not want to follow through and get a permanent protection order. Will the temporary order simply expire if I do not show up for the court date? Is there a better way to do it than not show up? Are there any ramifications to not showing up?

A:  If you do not show up for the permanent protection order hearing, the temporary protection order will simply expire and no permanent protection order will be entered. It is preferable to give the Court a courtesy call in advance and let them know that you do not intend to follow through and do not intend to show up. However, as the person who obtained the temporary protection order, there are no ramifications for you for not showing up beyond the temporary protection order expiring. If the other party has been served and does not show up, and if you do show up and ask for a permanent protection order, it will be entered. Beyond that, there are no ramifications for the other party for not showing up either....

Dead beat ex did not show up for our child support hearing. It is being rescheduled and Im sure he wont show up for that one either. If he doesnt, case gets thrown out!! How is that right?

A:  IF the deadbeat does NOT show up AGAIN ; your attorney can ask for a Summary Judgement in YOUR favor ... and most likely; will get it ... +5 Move to NY. Women don''t show up and they get half plus their legal fees. If you''re a man don''t ever get divorced in NY LAME....he should automatically lose if he doesn''t show! doesnt get thrown out, they give him a couple opportunities if he does not abide by that then they go off his income papers on how much he makes. He was suppose to provide that to the court for proof of income, or you can provide that. So they can start garnishing his wages. It own''t get thrown out- there will be warrant issued for his arrest for: 1. failure to appear 2....

Q:

I received a $100.00 jaywalking ticket that has no court date on it. What will happen If I don''t show up. Is this fine excessive?

A:  Jaywalking is a civil traffic offense. See A.R.S. Sections 28-121 and 28-793. That type of offense carries a maximum fine of $250 plus any applicable surcharges. Surcharges can add up to an additional 47% of the fine amount. If the citation sets no court date, then the $100 assessment is a bond guaranteeing appearance in court to resolve the citation. You should call the court to be sure that a hearing is scheduled. If the court datewas set and has already been held, then the bond amount is levied against you as a fine. If you appear in court and a fine is assessed, your failure to pay can result in collection action as well as the suspension of your driver''s license until all payments are made or until satisfactory arrangements for payment have been made. See...

Q:

A judgment was filed against me in court, I did not show up for the hearing?

A:  It depends on how much they know. If they know where you work and/or where your bank accounts are located, they can get an order for garnishment/levy pretty quickly. However, your lawyer will send letters (or should send them anyway) to all creditors with your notice of filing for bankruptcy with the case number. If your wages are garnished and/or bank accounts levied, the minute you get proof of filing, you (or your attorney) need to provide that to the court that issued the order to stay it and get the money back. You should have went in an stated that you filed. Find another lawyer Garnishments don''t happen overnight. Once the paperwork for your bankruptcy is filed with the courts an automatic stay is in place...

Not showing up for court?

A:  If they signed the court summons, the person was giving their word that they would show up for court. If they don''t show up for court a warrant for their arrest will be issued and their driver''s license will be suspended in their home state under the provisions of the non-resident violators compact (NRVC). (unless it''s in CA,HI,MI - which don''t honor the NRVC) They will issue a bench warrant for a fail to appear It will show up if there is a need to look for it by police or employment purposes, Best to go deal with it before matters get worse >>> Up to U They can issue a bench warrant, which isn''t serious, but it can block you from renewing your license and vehicle registration. Plus the fees will continue to build. A warrent can be issued and if your picked up in another state the...

What happens if a natural mother wants to give the child up for adoption but the father does not?

A:  If a mother does NOT agree to put the kid up for adoption, the father is on the hook for child support. Same rule applies in reverse. If the father blocks the adoption, the mother is legally responsible and has to either care for the child herself, or pay child support while the father cares for the child. (In theory. In practice, most custodial fathers are afraid that if they ask for child support the Mom will sue for custody and win, so fathers rarely ask for child support). Can the father block the adoption? The law in this area varies from state to state. The...

Q:

Cop does not show up to traffic court?

A:  The cashier had no business telling you that. A cashier simply handles money and has no legal training. There is no legal requirement to dismiss a ticket if an officers does not show. That, as you now know, is a myth. As long as the officer has a legitimate excuse, they can reschedule. When I worked day shift, there were several times I had a high priority call when I was scheduled for court. As long as I called and advised the clerk, they would always reschedule. You actually think that the CASHIER knows more about the law than the JUDGE? You''re just listening to the cashier because that''s what you WANT to hear. The fact that the officer didn''t show up is not reason for automatic dismissal. Ever. Yes, the judge can dismiss the case, but...

Q:

What will happen if one day we come to know that we are a creation of some alien creatures and not God?

A:  That sounds like a good god definition to me. Well to be fair, Alien contact could easily be confused with God like entities if you consider early man. Remember that most religious books were written in a time that most technology looked like magic or supernatural. Consider this for a second. Let''s say I was able to transport you back in time with a machine gun, medicine, a car, and the ability to connect to the internet to look up anything. The people back in biblical times would see you as a supernatural being and write it down in ways they can best describe your ''magic''. Example a person could write about your machine gun: ''God was angered, pointed his Holy staff and fire and thunder shook the earth the Earth repeatedly like Drums from Hell. Any entire army of soldier holding...
