2d amendment case: DC v. Heller

A:  I''m sure that this thread will get lost in the welter of gunnut glee over what they see as (in the words of one of them) a victory against those who hate freedom. Nevertheless, i was glad to see that you had commented. Thanks for the comment Joe. I haven''t had the time to look too deeply at the ruling but an interesting note about "keep and bear arms" in the little scanning I did. If it is constitutional to keep arms and if "bear arms" doesn''t have to be in context of militia that puts the possibility out there that no laws can be passed that restrict carrying guns. Yet Scalia states that carrying can be restricted in certain instances. (I don''t recall what his term was in talking about schools, etc.) No doubt this is going to lead a ton of...

Q:

Why is it the The Federal Courts don''t allow The U.S. Constitution and The attached Bill of Rights to be .

A:  I would love a link to the story. Sorry, but without some research my answer would be useless. I will star in the hopes of getting info. THX UPDATE OK, I am trying VERY hard to find the story, but the updates do not give me much direction. The paper name you gave doesn''t google. Help me! Can you give me a name, a paper, a charge, a city, heck, maybe even a county. Timeline would be great. I WANT TO KNOW MORE! UPDATE Urik Sorry, but the letter of the law is the law. McDonald v. Chicago: 2nd amendment Incorporated

A:  @joefromchicago, joefromchicago wrote:The Supreme Court held today in McDonald v. Chicago that the second amendment is incorporated through the fourteenth amendment. wait a minute, doesn''t that make it the 7th amendment @djjd62, Is that what it means? A R T @failures art, "Incorporation" means the process by which the rights guaranteed under the Bill of Rights are applied to the states through the due process clause of the fourteenth amendment. Prior to the fourteenth amendment, the supreme court held that the Bill of Rights only restricted congress from passing laws that violated the rights guaranteed...

Q:

Amending Revocable Living Trust ?

A:  Living Trusts can be amended in PRECISELY the way the Trust specifies they may be amended, assuming the person who created the trust is mentally comptent at the time. Other attempts at amendment are likely invalid. While in most cases a second amendment that amends only PART of the first amendment can be valid, it is really prefereable to amend an amendment by restating the entire provision, this time with the changes in it. It may be more typing but there is a smaller chance of error....

Q:

Are there any pros to gun control?

A:  No, absolutely no pros to gun control. I am against all forms of gun control. I also dont think dangerous criminals or nutbags should even be roaming the streets, if they are so dangerous they should be locked up, not paroled in a year. If we kept criminals locked up that would take care of our crime problem quickly. I think machine guns should be available to anyone never locked up. The second amendment guaruntees our right to bear arms, and that means any arms, not just hunting rifles or self defense weapons. It was put in place so that we the people could fight a tyrannical government, you can say the government wont get tyrannical, but the people of the Weimar Republic in Germany also thought that Hitler wouldnt take all power from...

HERE IS A PRO-FREEDOM CASE CITED BY THE USSC

A:  Comments r welcome. David Its always a bit of a thrill to see the USSC issuing libertarian decisions. David Quote:and all this for the important end to be attained: the rearing up and qualifying a well-regulated militia, so vitally necessary to the security of a free State. What value would small arms be to a militia? I assume youmean so you can shoot invaders. I would also assume any invaders would be armed with modern technology. I dont think you 6 gun is gonna get you very far. Why is this so vitally important to your security? @dadpad, dadpad wrote:Quote:and all this for the important end to be attained: the rearing up and qualifying a well-regulated militia, so vitally necessary to the security of a free...

McDonald v. Chicago

A:  A pdf copy of the transcript from today''s oral arguments: http://www.supremecourtus.gov/oral_arguments/argument_transcripts/08-1521.pdf The American Bar Association has a page with all the Briefs filed in the case. http://www.abanet.org/publiced/preview/briefs/feb2010.shtml#mcdonald Interesting reading from both sides of the issue. Anthony Ray wrote:"The police, urge people, to keep their guns locked up and unloaded" "Congress today, seems on the verge of approving gun control" [Verse One: Sir Mix-A-Lot] It''s, time to fight back cause the new jack black macks ain''t did SHIT about that, whack, jackin And I''m packin Cause I''m down for the bank I''m stackin And in a straight up brawl I''ll mall alla y''all Ya try to crawl for Tylenol and I install big fists in your...

Q:

WILL THE USSC LIBERALS PLAY IT STRAIGHT?

A:  @OmSigDAVID, It''s worrisome. I read an analysis a couple of months ago that ended with the following (with which I agree): Quote:It is a virtual certainty, of course, that any decision that emerges is likely to divide the Court deeply, as Heller did. Thus, the decision in the case is likely to be one of the last to emerge from the Court near Termís end. @Irishk, Monday, June 28, is the last day of the session. I expect it then, or less likely on Friday June 25. That is how thay handled the HELLER case in 2008, as we expected. Immediately after a pro-freedom decision in McDONALD, there is expected a flurry of pro-freedom summary judgments in other Federal Courts that are awaiting the McDONALD decision qua 2nd amendment related litigation on their dockets. David I...

Q:

School Expulsion

A:  The second amendment concerns the right to bear arms. Although there is no individual right to bear arms under the second amendment of the federal constitution, many states have created an individual right to bear arms in their state constitutions. Currently all states but six(California, Iowa, Maryland, Minnesota, New Jersey, and New York)have a constitutional right to bear arms. There is NO right to bear arms at school and therefore no violation in this case. http://www.legalmatch.com/law-library/article/second-amendment-and-the-right-to-bear-arms-lawyers.html...
