A:  Laymans take: The trustees duties take as long as it takes--which could run a long time. If in fact the living trust is valid the trustee is in charge of the trust--and for allpractical puroses the kids are out of the loop and there is o need for a will, at least as to the stuff in the trust, perhaps for the $10,000 to the kids if by will. I'm not sure whyit takes his continued presence--however if the kids are intent upon physical raids of Dads home the trustee may need to physically be there or hire somebody to guard the place 24/7 It may be critical to prevent one of the kids from squatting in the place and claiming to be a tenant under CA law.
