A:  The other woman, if she had a child with this man, can make just about any claim against the estate that she wants to make on behalf of a minor child or to the child's share under intestacy. The house will pass to the surviving spouse by operation of title and will not be part of the estate.  The surviving spouse won't lose the house over this one. Frankly, if this woman claimed that she had a child by this man, I would expect that the personal representative of the estate would want proof of the decedent's legal paternity.  I also would think that if she did have a child by this man, she would have sued for child support before his death and everyone involved would have known about it as DNA testing would have established...
