Q:

I live in Illinois. I want to review the file my lawyer has thatrepresents more than two years of litigation regarding an estate. I am the Executor, before I ''sign anything'' and close the case I want to review the entire case file. Are there restrictions on what I have access to? I''ve seen references to work product and other terms I don''t understand

A:  Because you as the Executor are the client, you have the right to review the entire case file of your own attorney without regard to any privileges that might be applicable to other persons. If your attorney has not been paid, he or she might in certain limited circumstances be entitled to withhold the turnover to you of part or all of the file through the assertion of an ''attorney''s lien.'' However, if you attorney has been paid, there are no circumstances at all in which you would not be entitled to review all the file documents. -- Michael T. Sawyier...

How to Create a case File Number

A:  In reviewing numerous law office case management software packages, we''re constantly amazed at the number of over-priced packages that have ''automatically creates a case number'' high on the list of features as if it''s a difficult thing to do, or even impressive as a package feature. We suggest that case numbers should be codes that tell you much more than a simple number does, but at the same time, should have a simple format so you can easily create them and read them on the fly. Q:

appeal question, case file incomplete? MD

A:  If you mean who gets punished in the severest possible manner for the mistake, probably nobody. You make it sound like somebody intentionally "tampered" with the file just to mess you up. Whatever paperwork is generated during a trial goes in the file. It's likely the judge's clerk that has the job of compiling all the paperwork before sending the file back to the records department. Go to the judge's office and talk to the clerk about the missing pages. It just might be that it's in a pile with hundreds of other papers and just didn't get matched up before the file got sent to records or sent to the appeals court. Don't do it by phone. ''Does the file just go from the Circuit Court to Annapolis, the MD State Capital, without anyone being required...

In California, once a police investigation case file is turned over to the DA and the DA chooses not to prosecute, is the investigative file available for production under a civil subpoena duces tecum?

A:  Not without a pending case, and at least one defendant served. Even then, you are going to get an objection that the investigative file is confidential, and I doubt you would get a court to compel its production....

Q:

Is a case docket and a case file the same thing....was told to get my case docket for my bankruptcy and can only find online how to order my case file.

A:  case numbers and docket numbers are the same thing. A docket, though, is a list of cases to be heard in a particular courtroom. A case file consists of all the documents filed with the court in a particular case. You may be looking for a docket report, which lists all documents that have been filed in your case. You can either ask your attorney for a copy or go down to the courthouse at 201 Superior and use a public terminal with Pacer to print off a copy. Good luck!...

Q:

Is there a way to find out if a case has been filed? Do malpractice attorneys search for living dependents or do they take the word of the one filing it? My older brother has all the papers and a case was filed for my mother dieing on the operating table in Banning California in April 2008. The state stepped in and there was probable cause to file, yet my older brother wouldn''t say much and he had all the paperwork and information. Brother and I do not talk anymore so I was wondering if I could find out if he continued on with the case. I now live in Carson City NV, so I am entering my zip code. Thank you for your help. Debra

A:  You and try to find the answer online. I cannot remember if Banning is in San Bernardino or Riverside County. Both counties have a website that allow you to do a search for cases by name. You do a Google search for the website: San Bernardino County Superior Court; Riverside County Superior Court; with both websites you can do a case search by name; you can put in the name of your brother, the name of your mother, etc. and do the search. I think Banning is San Bernardino County but you can do a Google search on that too....

What happens if jailers steal an attorney's case file?

A:  Kscoinhutch wrote: What happens in this situation? What would you lawyers do if this happened to you? A man is in a county jail awaiting trial on a low-level felony. He is also charged with harrassing a policemans''s daughter. One day he is taken to court for a pre-trial hearing. While in court, his court-appointed attorney allows him to "borrow" several pages from the lawyer''s case file to take back to the jail and read in order to assist the lawyer, with strict instructions to return the papers to the lawyer at the next court hearing. A couple days later, jailers enter the defendant''s cell and seize the legal papers in front of...
