Q:

I have a great idea, but will I be able to get a patent and protect my idea?

A:  Look at the Smuckers crustless peanut butter and jelly sandwich patent.  FYI, Google has a patent search engine at http://www.google.com/patents BTW, if you have a further question after reading that, please consider asking your question as a single sentence, beginning with a capital letter and ending with a question mark. MYK, thanks for the response and the additional info about the google patent search.   Actually, I''ve read many articles on the smuckers patent and I ended up back to square one- alot of useful info, but I still wasn''t able to conclude anything.  I realize patent law is one of the toughest types of law...

Q:

A:  I think the beard was an excuse.................You can''t even spell *illegal* yet want to work in a lawyer''s?? just shave and then re-apply Hi dont know about the USA but it is legal in the UK to have company policies on facial hair no they do not have to hire you they have a dress code and if you are not willing to meet there code then no they do not have to hire you want a job, shave it is an employers choice, you are representing that company working with the general public and appearance is an important part of that job....

Q:

I was included in a patent, but no longer work for that Company

A:  If you did your part of the inventing as an employee of the Company, then you have no ownership rights. To answer your questions: (a) Leaving the organization does not change this. (b) You have nothing to sell. (c) Waivers of ownership are only important if you were not an employee -- i.e., if you had been an independent contractor. Wish I could help, but there seems to be nothing to do about this situation. Glad to suggest counsel at my old firm in Florida if you want to talk to a trial lawyer about what claims you could or could not bring. Best wishes,...

Q:

What is the salary of an corporate lawyer? and what is the job description?

A:  Avg Salary: $120k Check out here for the details: http://www.whatsalary.com/us/job-title/c For a lawyer: $90k Details: http://www.whatsalary.com/us/job-title/l Previous-poster ''kapn'' is right on target - again. Choosing a career is one of life''s most important and difficult decisions. We simply already have way too many Legal Professionals. AND the legal profession is dramatically changing; it is in absolute CRISIS!! Job searching in this vocational field has changed >>DRAMATICALLY Jobs in the field of Law are drying up fast! This no longer is a good field to invest time and/or money into. This is a SHRINKING, crumbling, and dying vocational field. Many, many reasons. We now have computers. So, many people today (mistakenly) think they can do their own legal...

Q:

Why is it going to cost me over $700 to get my Oregon license transferred to Illinois?

A:  IL was one of the states that was issuing fraudulent CDL a few years ago (2001-02 I believe), along with FL & a couple of others. In fact former IL Governor Ryan went to jail over the illegal CDL schemes that was found to be happening in IL. This law is due partly to fix that problem & for the simple fact that I truthfully believe IL is an anti-truck state, especially the split speed limits. And I just researched the IL laws, & when moving to IL, you will have to take all necessary written exams, a vision screening, and the website states "if needed" the road skills tests....

Q:

Can a legal contract require that one of the parties give up his legal ownership of a copyright?

A:  Yes and it happens quite frequently. This is how Walt Disney lost the copyright to Oswald The Lucky Rabbit which prompted him to come up with a new cartoon character which he named Mickey Mouse. Copyright is not just one right. It is a bundle of rights. One could write the pilot for a television show and sell it to a studio while still retaining rights to derrivative works based on that show. Often the ''writers'' of the show are not the ones who first came up with the idea. The writer of the pilot sells the show to studio in a contract. In this contract, the original author can retain certain rights and sell them to other people such as rights for merchandising, movie rights, spin offs etc. Perhaps the author made a play or musical and wants to continue performing it, but someone wants to...

Q:

How to dispute a patent Pending?

A:  If their patent application is still unpublished, you could file a protest, including submission of prior art patents and publications that would render their application obvious. You would need to be able to identify their patent application specifically enough that the USPTO can find it.  MPEP chapter 1900 discusses this.  Looks like you must be able to give the application number;  if you don''t already know it, you might ask your lawyers if they can somehow demand it. Could someone please explain to me what is the purpose of stamping "Pat Pending" on a product?  Does it simply mean that an application has been submitted to the patent...

Q:

Copyrightable elements in a patent application

A:  This has been asked here before.   Here''s a link to one past discussion. http://www.intelproplaw.com/ip_forum/index.php?topic=3828.0 I haven''t done any research, but my guess is that nobody does much suing for copyright infringement of patent applications. I''ve thought about copyright in a patent application in the case of having another practitioner take over work. Situation 1.  Client thinks the estimate is way too high and announces such a few days before filing, then hands the draft by attorney 1 to another practitioner who''ll file it for the client for a little more than the filing fees, leaving attorney 1 with a rebuked, 5-figure invoice.  What''s the first attorney''s recourse without asserting copyright as to...

Q:

How much does an adoption cost for the person giving up the child?

A:  There is no charge for someone putting their child up for an adoption. It''s free. The expenses are normally paid for by the people adopting the child. A life time of regret and worry, paid on the installment plan... But your paper will contain a false dichotomy fallacy if you pair abortion with adoption. Abortion pairs correctly with parenting the child. Parenting pairs up with adoption. It mostly depends on if there is a battle but...some lawyers have a tendency to Stretch out the time to do anything with courts. I was able to adopt my 2 for just the paperwork cost. No father to contest. To the person who is giving up her child. Their are no monies involved in that. Usually Medicaid or the adoptive couple will...

Q:

disclosing a patent application #

A:  To put more context to my previous post, I wrote a patent application for a friend of mine and he has meeting with potential investors next week. I think the people will be more impressed with him if he can actually tell them his patent application serial no. instead of just saying ''patent pending.'' If I recall, the argument against divulging an application serial number was on the theory that someone might try to do harm to the application and they might make some progress in doing so.  I''m not entirely sure that concern is warranted. As much as I work my paranoid mind around this issue, I have a hard time finding any serious downside to providing an application serial number, especially if the application...
