Q:

What can be recovered in collecting debt?

A:  Q1) "Assuming I win the case, can travel expenses in collecting the debt be included in the judgement?" A1) No. Q2) "What costs in the process of collecting a debt can or cannot be included in the judgement?" A2) Your actual damages plus the costs of court (filing and legal service). Q3) ''Can filing costs for wage garnishment (or however the debt is taken care of) be included as well?" A3) After you receive the judgment, you may be forced to spend additional moneys to enforce the judgment. REASONABLE fees can be added to the judgment amount by the court. Q4) "I''m pretty sure this is a no, but is there any possibility of taking the case to a Texas small claims...

Q:

i bought a truck from this girl and i still owe her a some and she will not meet me. what do i do

A:  From what you''ve stated I see no problems. She really has nothing to stand on. You most likely will win the case but will still have to pay what is owed. With receipts she can''t dispute what you claim is owed. I see this as a scare tactic on her part. My advice is to send her a check (of what''s owed) by certified mail.. Giving you more evidence of attempt to pay. If it actually goes to court (which I doubt) take all receipts, conversations (letters/email of intent) and a diary of attempts to pay (with witnesses if any) plus the refused certified attempt (unopened) and your check book with you....

Q:

what will happend if i press charges against my nighbor that has been watching and touching himself, i dont have any physical proves

A:  let me know if you are or were in a situation like this, any advice too. You have evidence...what you saw and the corroboration of your husband. You have this question posted in the Civil Litigation, when in fact it is a criminal offence. Don''t worry about pressing the charges that''s up to the police to conduct their investigation and if there is enough to warrant a charge, they''ll lay it and call the two of you as witnesses. The key to success in your case is the tenacity of the investigator....

Q:

Should I have sued him? Would I have won?

A:  This guy doesn''s sound like a jerk. He stopped, asked if you were ok, and you said yes. Not much else you can expect him to do. It was dark, too. I wouldn''t expect you to get anything out of the case. By the time you go to court, you wouldn''t have any proof of injury! You''d probably get at most a couple hundred bucks, your lawyer would take some (probably wouldn''t even be with the lawyer''s time for the case) and you''d have wasted a bunch of tome being a jerk. Thank you for not clogging our judicial system with stupid cases. usually if u know u didnt cause the accident u will definitely win the sue case What would this do,...

Q:

I want all my med bills covered. Can I sue in small claims court?

A:  Yes .You can sue for the car accident in the small claims court. In United States these courts resolve monetary disputes, usually between $2,500 and $7,500, depending on the state. Not only for the medical bills, but also for the damages caused to the car you can sue. But it?s solely the court to decide whether your claim should be allowed or not. Surely you can sue but you may asked to give your car for investigation of damage.I advise you don''t claim more than the actual damage as the people usually do. The victim can claim compensation for pain and suffering from auto insurance under specific circumstances as stipulated by the insurance laws. The state laws in this regard are...

Q:

Should I learn to drive standard?

A:  I recommend it. You will thank your Dad and anyone else who encourages you later on. I did the same thing when I purchased my first car. It was a 1991 Ford Escort 5 speed. I miss that car dearly. You will also appreciate the added gas mileage, better traction control in bad weather, and once you learn you never forget. I highly recommend it. As for the wear, the only thing I ever had to replace was the clutch at 130,000 miles. It cost me around $500 for a new one which included installation at my local transmission shop. When you replace the clutch it is a good time to replace the transmission fluid too. So yes over all it is much cheaper to maintain a standard versus an automatic which will cost you transmission fluid and filter changes....

Q:

I'm at a total loss... can anyane help?

A:  http://www.megalaw.com/tx/txcodefiles.php?file=http://www.capitol.state.tx.us/statutes/fa/fa0015700.html#fa001.157.001 Okay, I found this site, and if I''m reading it correctly, all that is required is a Notice of Hearing. If anyone would be kind enough to take a look and tell me if that is the same understanding you get, I would SOOOOOO appreciate it! I''ve been at this all day, and I''m afraid my brain could be fried! sbaldwin, your best bet is going to be to call that clerk back, and write down exactly what it is you need to file with the motion. A lot of people are under the misconception that you file just a motion, and you''re done. There are other things that have to be filed with it as well, depending on what state your in, and your local court. Such as my...

Q:

PI mediation in Oregon?

A:  It is certainly possible you have a very good case based on what you say here; you really should take a brief description of these events as well as your medical records to an injury attorney and see if the attorney thinks you have a claim; often you need to contact several attorneys to find one to take the case; the review of your case and records is often free and then they will normally take the case on a contingency fee basis if they think you can win; you would pay only if they collect for you......

Q:

If I rent a car and let someone else drive it, do I get in trouble if they get pulled over or in an accident?

A:  It depends upon the wording of the contract but, yes, in most cases you, as the signer of the contract, are the stipulated driver and will be in breach if an accident occurs while you are not driiving. If you know that someone else might be driving make sure they are listed on the contract as an alternate driver. Also make sure they have their own valid insurance coverage. pardon my bluntness but i would simply ask at the car rental place. They get the tickets. The police don''t care who rented the car. You get in trouble with the rental company if the car is damaged because you told them you are the only 1 driving it. The cop will give the...

Q:

What will happen if u flee the sceen of a very minor accident and the other party took down your platenumber?

A:  Most state laws provide penalties for anyone who leaves the scene of an accident. It''s much worse if personal injury is involved. At this point you will need to comply with all legal and DMV requirements, accept the consequences of leaving the scene, and learn never to do that again. You will very likely be asked to make a statement for the police and DMV after which you will receive a citation for a fine or possibly to appear in Court. You broke the law, and will be charged with leaving the scene of an accident. You don''t have to wait for the police (they don''t even have to be called in most cases unless the damage is over some legislated amount), but you do need to stop and provide all insurance and ID...
